Child Arrangement Orders
When couples have a relationship breakdown, it is the children who suffer the most. One parent may be reluctant to allow the other parent to see the child. A child arrangement application will allow the Family Court to make a decision with whom a child is to live, spend time or otherwise have contact and when a child is to live, spend time or otherwise have contact with any person. Attend Mediation unless exempt.
APPLICATION AND SERVICE
Submit child arrangement order application to the Family Court to start the process. Once the application is issued, serve documents to the other party, who responds to served documents.
CAFCASS
Safeguarding inquiries with the police and social service start.
FHDRA
First Hearing Dispute Resolution for the purpose of encouraging resolution. The Family Court will give further directions following the first hearing.
FACT-FINDING
A fact-finding hearing is conducted if required. Thereafter, a CAFCASS report is conducted if necessary.
RESOLUTION
An attempt is made to reach an agreement.
FINAL HEARING
Both parties give evidence, and then the Judge makes a decision. A Court Order was issued stating the responsibilities and contact arrangements.
